General Policies

The Terms of Service described herein are subject to change without notification; any terms not specifically covered in this policy are subject to interpretation and change by Alpha Omega Webs without prior notice.  These Terms of Service are considered a legally binding contract between you (the customer) and Alpha Omega Webs.  By establishing Alpha Omega Webs as your internet hosting provider, you consent to the Terms of Service.  Alpha Omega Webs maintains the right to terminate any account found in violation of these Terms of Service without prior notification.  We reserve the right to remove any account with 15 days prior notice.

Content

Alpha Omega Webs provides services for lawful purposes only.  The transmission, storage, or presentation of any information, data, or material in violation of US Federal, State, or Local law in prohibited.  This includes, but is not limited to:

• Copyrighted material
• Material we judge to be threatening or obscene
• Material that jeopardizes national security
• Material that is protected by trade secret or other laws

The customer agrees to indemnify and hold harmless Alpha Omega Webs from any claims resulting from the customer's use of our services which damages the customer or any other party.

Pornography and sex-related merchandising are prohibited on any Alpha Omega Webs server.  This includes sites that imply sexual content or link to adult content elsewhere.  In addition, Alpha Omega Webs prohibits the use of their services to promote, advertise, or practice gambling in any form.

Alpha Omega Webs also restricts customers from using our services that promote, advertise, or practice any illegal activity or content, or that has the capability of damaging our servers or any other server with access to the internet.  Links to such materials or content is also prohibited.  Examples of prohibited content or links include, but are not limited to:

• Pirated software
• Hacking programs or archives
• Warez sites
• Adult sites
• Game servers (dedicated game server programs)
• Distribution of music files or other material which the customer does not hold the copyright

Alpha Omega Webs will be the sole arbiter as to what constitutes a violation of this provision.  Content that does not meet these standards will be removed without prior notice to the customer.

The following files are restricted from use on Alpha Omega Webs servers:

• ShoutCast Servers--due to bandwidth and load issues
• Background running programs--customers are asked to request permission before enabling persistent background processes of substantial load.
• IRC--IRC, Egg Drops, BNC, or IRC bots are not allowed on our servers.  Files with reference to IRC or any likeness thereof are prohibited.
• PortScanning--no portscanning is allowed on or from our servers.
• PHP Shell--PHP Shells or any likeness thereof are prohibited.  Files with any reference to PHP Shells or any likeness thereof are prohibited.
• Commercial advertising & Email Spamming--the sending of unsolicited email from any Alpha Omega Webs server or any address maintained on Alpha Omega Webs servers is strictly prohibited.  Alpha Omega Webs will be the sole arbiter as to what constitutes a violation of this provision.  This also includes Optin Optout mail programs and mail that either directly or indirectly references a domain contained within an Alpha Omega Webs account. Server Abuse

Any attempts to undermine or cause harm to a Alpha Omega Webs server or customer is strictly prohibited. This includes, but is not limited to:

• Logging into a server or account that you're not authorized to access
• Accessing data or taking any action to obtain services not intended for your use
• Attempting to probe, scan, or test the vulnerability of any system, subsystem, or network
• Tampering, hacking, modifying, or otherwise corrupting or breaching security of authentication measures without proper authorization
• Transmitting material that contains viruses, Trojan horses, worms, time bombs, cancelbots, or other  computer programming routines or engines with the intent or effect of damaging, destroying, disrupting or otherwise impairing a computer's functionality or the operation of the system
• Interfering with, intercepting, or expropriating any system, data, or information
• Interfering with service to any user, host, or network including, without limitation, by means of overloading, "flooding," "mailbombing," or "crashing" any computer system.

You will be held responsible for all actions performed by your account whether it be done by you or by others with access to your account. Top  ▲

Interruptions to Service

Alpha Omega Webs attempts to provide continuous service, 24 hours a day, seven days a week as much as practically and reasonably possible.  The customer acknowledges that services may be inaccessible or inoperable from time to time due to periodic maintenance/upgrades ("Scheduled Downtime"), service/equipment malfunctions, or causes beyond our control, such as interruption or failure of telecommunications or digital transmission links, hostile network attacks, network congestion, or other failures.  Alpha Omega Webs will provide at least 48 hours advance notice to customers for scheduled downtimes, while making commercially reasonable efforts to minimize any other disruption to services.  Alpha Omega Webs assumes no responsibility for downtime resulting from a user's actions. Usage

Any account using 15% or more of the server CPU or memory can be suspended and/or terminated.

Any account that uses excessive amounts of bandwidth can and will be subjected to bandwidth throttling.

Unauthorized background processes shall result in immediate termination of the account.  Alpha Omega Webs maintains the right to cancel accounts at its discretion. Top  ▲

Copyrighted Materials

Alpha Omega Webs policy is to accommodate and not interfere with the standard technical measures taken by copyright owners to identify and protect copyrighted works, insomuch as they:

• are developed pursuant to a broad consensus of copyright owners and service providers in an open, fair, voluntary, multi-industry standards process
• are available to any person on reasonable and nondiscriminatory terms
• do not impose substantial costs on us or place substantial burdens on our systems or networks.

If you believe your work has been copied in such a way that constitutes copyright infringement, please provide the following information to Alpha Omega Webs:

• An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest
• A description of the copyrighted work in question
• A description of the location where the work in question is located on the site, including the auction I.D. number, if applicable
• Your mailing address, phone number, and email address
• A statement by you that you have good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law
• A statement by you, made under penalty of perjury, that the above information in your notice is accurate, and that you are the copyright owner or are authorized to act on behalf of the copyright owner.

If Alpha Omega Webs is notified of a credible claim of copyright infringement, or otherwise becomes aware of facts and circumstances from which infringement is apparent, it will respond expeditiously by removing or disabling access to the material in dispute.  Alpha Omega Webs may terminate the accounts of repeat offenders of copyright infringement.
